GENERAL TERMS AND CONDITIONS WATERSTATE WELLNESS HOTEL GOES & VITAE WELLNESSRESORT

APPLICATION OF GENERAL TERMS AND CONDITIONS
These general terms and conditions apply to all reservation requests, online orders and agreements concluded, directly or indirectly, with Waterstate Wellness Hotel Goes.
1.2. Waterstate Wellness Hotel Goes expressly rejects the application of any other general terms and conditions.
1.3 Exceptions to these general terms and conditions are only possible if the parties have agreed to them in writing.
2.
RESERVATION
2.1 Waterstate Wellness Hotel Goes only accepts reservation requests from persons aged 18 or over. Waterstate Wellness Hotel Goes reserves the right to refuse a reservation request, without giving reasons.
2.2 For online bookings/reservations, the agreement between Waterstate Wellness Hotel Goes and the guest is concluded when the guest has confirmed the reservation and/or payment has been made through the payment module, or a credit card has been issued as a guarantee. For reservations made by telephone, the agreement between Waterstate Wellness Hotel Goes and the guest is concluded at the moment Waterstate Wellness Hotel Goes has sent the reservation confirmation to the guest by email.
2.3 The guest should check the reservation confirmation for accuracy. Any inaccuracies should be reported to the hotel immediately.
2.4. When booking a guest's visit online, a guest provides an expected arrival time and departure time. Any additional booked treatments at the nearby Vitae wellness resort will be scheduled between the times given by the guest. No exact treatment times are ever provided by Vitae Wellness Resorts; the guest is told these times upon arrival.
2.5. Should the scheduling of any treatment not be possible within the arrival and departure times specified by the guest, the Vitae Wellness Resort concerned will contact the guest by telephone or e-mail within two working days.
2.6 The guest shall make payment to Waterstate Wellness Hotel Goes, within the period specified in the booking confirmation. Waterstate Wellness Hotel Goes is entitled to consider the agreement as not concluded if the hotel does not receive the agreed (partial) payment within the stipulated period. In that case, Waterstate Wellness Hotel Goes has the option to release the served services and/or entrance access to other guests without further notice. In addition, Waterstate Wellness Hotel Goes has the right to charge cancellation fees.
3.
CHANGES TO THE RESERVATION
3.1. Waterstate Wellness Hotel Goes is not obliged, after the formation of the agreement, to make changes to the agreement at the request of the guest.
4.
PRICES
4.1 The guest owes Waterstate Wellness Hotel Goes the agreed amount as stated on the booking confirmation.
4.2 Prices and additional costs are listed on the Waterstate Wellness Hotel Goes website www.waterstate.nl and www.vitaewellnessresorts.nl, and are all inclusive of VAT.
4.3 Unforeseen government-imposed price increases may be passed on to the guest. All prices on the website and other expressions such as brochures, posters and leaflets, are subject to change. Hotel room prices change daily and are always subject to availability.
4.4 Discounts published after a reservation/booking or purchase has been made cannot be applied retrospectively.
5.
PAYMENT/CANCELLATION
5.1. If the guest is unable to attend, we ask the guest to contact the hotel by telephone.
5.2. No costs will be charged for cancelling only a sauna visit. If the guest has reserved a treatment or package including treatment or booked a hotel room, Waterstate Wellness Hotel Goes applies the cancellation conditions stated under heading 5.3.
If the guest wishes to cancel a booking, the cancellation policy depends on the rate booked. In the case of a non-refundable rate, this cannot be cancelled under any circumstances. For a regular rate, the guest can cancel free of charge up to 24 hours before arrival. If the guest cancels within 24 hours before arrival, he/she is obliged to pay the amount stated on the booking confirmation, which must be paid to Waterstate Wellness Hotel Goes within 8 days. The flexible rate is higher than the other rates, allowing the guest to cancel free of charge until 12:00 noon on the day of arrival. After this time we will charge 50% of the amount mentioned on the booking confirmation, or we will move the booking to another date free of charge by mutual agreement.
5.4. The guest shall not be entitled to a (partial) refund of the amount, if the guest has been unable to use all services and/or accommodation on his own initiative and through no fault of his own.
6.
(DOMESTIC) REGULATIONS
6.1 Guests must comply with the rules established by Hotel Waterstate and Vitae Wellness Resorts. These can be read on the website and in the hotel. Hotel Waterstate and Vitae Wellnessresorts has the right to immediately remove its guests from the hotel (or have them removed) if the housekeeping rules are violated and/or instructions from the staff are not followed. In that case, the guest is not entitled to a refund of (part of) the paid reservation, or the consumptions and/or treatments already consumed.
6.2. Hotel Waterstate is entitled to ask the guest for valid identification before check-in. Hotel Waterstate is entitled to refuse access to the hotel and wellness resort concerned to guests who are unable to identify themselves.
6.3. Hotel Waterstate and Vitae Wellness reserve the right to make changes to the set-up and opening hours of the facilities. The guest shall allow maintenance to take place during opening hours if necessary. The guest cannot claim compensation. The necessity of maintenance is at the discretion of the management of Hotel Waterstate.
7.
VALIDITY
7.1 The validity of tickets and/or gift vouchers in circulation are expressly indicated on the ticket and/or gift voucher in question. If the validity of the relevant ticket and/or gift voucher has expired, the validity cannot be extended.
7.2 A reservation/booking made is only valid on the day indicated by the Guest. The guest cannot derive any rights from the reservation on other days.
7.3. If the guest is in possession of a discount voucher, e-ticket or other gift voucher, the guest must actually hand these in when checking in, unless expressly stated otherwise. If the guest cannot hand over this discount voucher, e-ticket or other gift voucher, the hotel is obliged to charge the full rate.
8.
LIABILITY
8.1. Hotel Waterstate and Vitae Wellness Resorts accept no liability for theft (including theft from wardrobes), loss and/or damage to property or persons, of whatever nature, during or as a result of a stay at Hotel Waterstate.
8.2. Hotel Waterstate and Vitae Wellnessresorts accept no liability for the fact that the guest's stay does not meet the expectations the guest had set for it.
8.3. Hotel Waterstate and Vitae Wellnessresorts accept no liability for damage or injury caused to property or persons as a result of a stay on the premises of the Vitae Wellnessresorts in question or caused by the use of the facilities on the premises.
8.4. Hotel Waterstate and Vitae Wellnessresorts are not liable for damage claims arising from noise nuisance caused by third parties.
8.5. Hotel Waterstate and Vitae Wellnessresorts are not liable for damage claims arising from information provided verbally or by telephone by its employees.
8.6. Hotel Waterstate and Vitae Wellnessresorts are not liable for facilities and/or facilities becoming inoperable and/or out of order.
8.7. The guest is obliged to pay all extra costs resulting from the incorrect use or incorrect abandonment of the facilities.
9.
PRIVACY
9.1. In compliance with the General Data Protection Regulation, Vitae Wellnessresorts will treat the personal data of the guest strictly confidential.
9.2. Personal data concerning the health of the client are only collected for safety reasons and for the possible preparation of appropriate advice or treatment. These data are therefore used exclusively for that purpose and will not be disclosed to third parties without the express consent of the guest.
9.3 The e-mail address provided by the guest during the reservation or purchase process will be included in Hotel Waterstate's e-mail database, unless the guest has specifically turned it off. Should the guest not wish to receive these emails, the customer may unsubscribe by clicking on the relevant link in any email the guest receives from Hotel Waterstate. Telephone or email unsubscriptions will not be processed.
9.4. By signing any direct debit authorisation for e.g. a subscription or making a reservation/booking, the guest agrees to the processing of the guest's personal data as described earlier in these general terms and conditions.
10.
COMPLAINTS
10.1 Despite the care and efforts of Hotel Waterstate and Vitae Wellnessresorts, it may happen that the guest has a complaint. Complaints can be reported directly to the hotel's front desk. If a complaint cannot be resolved or it is not resolved to the guest's satisfaction, the guest should send the complaint in writing or send it by e-mail to the management. This course of action is absolutely necessary for the complaint to be handled properly.
10.2 In all cases not provided for in these General Terms and Conditions, the management of Hotel Waterstate and Vitae Wellness Resorts shall decide. By using the relevant Hotel Waterstate and Vitae Wellnessresorts and all its facilities, the client accepts these General Terms and Conditions.
10.3 All agreements between the guest of Hotel Waterstate and Vitae Wellnessresorts are governed by Dutch law.
